Terms of Service

Effective September 18, 2026

SpendingPath is operated by DGOURD LLC, a Tennessee limited liability company (“we,” “us”). These terms govern your use of the streamlined model, the paid scenario tool, and the website they run on (together, the “Service”). Using the Service means you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

Who can use the Service

You must be at least 18 years old to create an account or subscribe. By using the Service you confirm that you are.

What the Service is

The Service solves a mathematical model of lifetime spending and investing from the assumptions you supply. It is educational software, not a determination of what you should do with your money. See the disclaimer shown above every result for the full statement of what the Service is and is not. The model uses one set of economic assumptions and one tax year's federal rules. Its output will not match your actual results.

No professional advice

The Service does not provide investment, tax, legal, or accounting advice, and we are not a registered investment adviser, broker-dealer, financial planner, tax preparer, or law firm. Nothing in the Service is a recommendation to buy, sell, or hold any security or to follow any saving, spending, withdrawal, or contribution strategy. Using the Service creates no advisory, fiduciary, or other professional relationship between you and us.

Your responsibility

You are responsible for the financial decisions you make. Before relying on any figure the Service produces, verify the assumptions behind it and the current state of any law it models, and consult a licensed financial, tax, or legal professional about your own situation. You are also responsible for the accuracy of the information you enter.

Eligibility for the paid tier

The paid tier's tax modeling implements United States federal tax law only: no state tax, no other jurisdiction's tax, and no tax year the bundled tables do not cover. It is offered to United States residents and taxpayers, and we accept payment only from a United States billing address. We do not verify residency or citizenship at signup; this is a stated condition of use, not a technical restriction. If you are not a US taxpayer, the paid tier models a tax system that is not yours, and you should not subscribe expecting otherwise.

Your account

Keep your password confidential and do not share your account. You are responsible for everything that happens under it. One account per person. If you think your account has been compromised, email us at [email protected].

Subscriptions, billing, and automatic renewal

The paid tier is a subscription. After the free trial described below, it is billed in advance at the price shown at checkout, and it renews automatically at the end of each billing period (monthly) until you cancel. By subscribing you authorize us and our payment processor, Stripe, to charge your payment method for each renewal. Stripe handles your card details under its own terms and privacy policy; we never see your full card number. If we change the price of your subscription, we will email you at least 30 days before the new price takes effect, and you can cancel before then. Sales tax is added where the law requires. We will email you before your free trial ends and before each renewal that changes your price. If a payment fails, we may suspend the paid tier until it is paid.

Free trial, refunds, and cancellation

Your subscription starts with a 3-day free trial. We ask for a payment method when you start the trial, but we do not charge it until the trial ends on the date and time shown at checkout. Cancel from your account page before then and you will not be charged anything. If you do not cancel, your subscription starts automatically at the price shown at checkout. One free trial per person; we may refuse a trial to anyone who has had one before. You may cancel your subscription at any time from the account page; cancellation takes effect at the end of the period you already paid for, you keep access through that date, and there is no partial-period refund. Payments are not refundable except where the law requires.

Your content and our rights

You own the numbers you enter and the scenarios you save, and you give us permission to store and process them to run the Service for you. We own the Service, including the model, the software, the site text, and the format of the charts and reports it produces. We give you a personal, non-transferable license to use the Service and its output for your own personal planning while these terms are in force. You may not copy, resell, or redistribute the Service; access it with bots, scrapers, or other automated tools; reverse engineer the model; or use the Service to build a competing product. If you send us feedback, we may use it without owing you anything.

Changes to the Service and your account

We may change, suspend, or discontinue the Service or any part of it. Saved scenarios stay available to view while the Service operates, even if your subscription lapses. If we shut down the paid tier, we will give at least 30 days' notice by email and refund any prepaid amount for the period after shutdown. We may suspend or close your account if you break these terms.

No warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranty of accuracy, merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the Service is free of errors or that its output matches your actual financial future. Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by law, our total liability to you arising from or relating to the Service will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim arose. This limit applies regardless of the legal theory of the claim. It does not limit any liability that the law does not allow to be limited, such as liability for fraud or willful misconduct.

Exclusion of consequential damages

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, income, or data, arising from your use of the Service. Some states do not allow these limits, so they may not apply to you.

Dispute resolution

Talk to us first. If you have a dispute with us, email [email protected] with a description of the problem and give us 30 days to try to resolve it before starting any formal proceeding.

Binding arbitration. If we cannot resolve it, any dispute arising out of or relating to the Service or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted by phone, video, or written submissions, or in the county where you live if there is an in-person hearing. The Federal Arbitration Act governs this section.

Small claims. Either of us may instead bring an individual claim in small claims court.

No class actions. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. If this class waiver is found unenforceable for a particular claim, that claim will proceed in court under the governing law and venue section, not in arbitration.

Opt out. You may opt out of this arbitration section by emailing [email protected] within 30 days after you first accept these terms, with your name and account email. Opting out does not affect the rest of these terms.

Governing law and venue

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws rules. Subject to the dispute resolution section, any court proceeding will be brought in the state or federal courts located in Davidson County, Tennessee, and you consent to their jurisdiction. If you live in a state whose consumer protection laws give you rights that cannot be waived, nothing in these terms takes those rights away.

Changes to these terms

We may update these terms from time to time. The date at the top of this page is when it was last changed. If a change materially affects paid subscribers, we will email you at least 14 days before it takes effect. Continuing to use the Service after a change means you accept the updated terms.

General

These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part of them is unenforceable, the rest still applies. We may assign these terms to a successor to the business; you may not assign them. If we do not enforce a term, that is not a waiver of it. The sections on professional advice, warranties, liability, and dispute resolution survive the end of your use of the Service. You agree to receive notices from us by email at the address on your account.
